In applying to participate in the exhibition, applicants agree to the following Terms and Conditions:
Artwork Submission
The artist agrees to submit artwork for the exhibition based on their own selection and judgment. Each piece will be selected on its own merits and no preference will be given to any specific medium or piece.
If entries received exceed the maximum that can be displayed the closing date for submission may be earlier.
Insurance and Liability
All reasonable care will be taken, however Artiste Online will not be held responsible for any loss or damage to artworks during the event or thereafter. Artists are encouraged to arrange their own exhibition insurance.
Artiste Online maintains general insurance, however, it is the Artist’s responsibility to insure for loss, damage or otherwise for Artwork left in the possession of Artiste Online.
The Artist may opt not to insure their Artwork but that decision is at the sole discretion of the Artist, and the Artist agrees not to make any claim against Artiste Online’s insurance for loss, damage or otherwise.
Delivery and collection of artworks
Exhibiting artists must deliver and collect their artworks at the agreed date and time to the address supplied by Artiste Online
Exhibiting artists unable to deliver or collect their artworks must arrange for transportation of their appropriately wrapped artworks at their own expense within the time frame indicated by Artiste Online. Any damage or loss of artworks during transit is at the risk of the Artist
The artist is responsible for ensuring all that works are complete, securely framed and ready to be hung. Hanging hardware will be provided.
All artwork must be clearly labeled with the name of the artist, medium, title and sale price of the exhibit on the BACK or underside of each artwork.
Individual artworks cannot exceed 5 kg
Display and presentation
Artiste Online reserves the right to determine the layout, arrangement, and positioning of artworks within the exhibition space.
Artiste Online will provide a standard hanging system. If Artwork requires a special hanging or display system, the Artist will provide the special hanging or display system and will be responsible for the installation.
Any specific display requirements or instructions should be communicated to Artiste Online in advance, no later than 10 working days prior to the start of the exhibition.
If work is delivered and the Artiste Online team deems it unsuitable for hanging, Artiste Online may opt to keep the work in storage or request the Artist adjusts the work’s hanging.
Promotion and Marketing
Artiste Online reserves the right to use images of the exhibited artwork for promotional and general purposes including, but not limited to online and offline marketing materials, social media and press releases. Where possible the artist will be attributed appropriately.
The artist grants Artiste Online a non-exclusive, royalty-free worldwide license to reproduce images of their artwork for the purpose of promoting the exhibition
Ownership and Sales
Unless otherwise specified the artist retains full ownership and copyright of their artwork.
The Artist reserves the right to decide who may purchase their artwork exhibited at the event.
Artists are responsible for managing sales of their works.
Artworks sold must remain on display for the duration of the scheduled exhibition.
Commission Payable
Commission fees for Products sold during, following, and or as a result of ARTISTE ONLINE art shows and exhibitions is payable at the rate indicated by the subscription level selected by the Artist. The amount of this commission excludes taxes and shall be increased by any applicable taxes, including the value added tax (VAT) at the prevailing rate on the billing date. The commission can be billed for any order placed via the Platform and for any sales made during, following and or as a result of any ARTISTE ONLINE art exhibition and or art show.
Withdrawal of Artworks
Once artworks are accepted for the exhibition, withdrawal requests can only be considered under exceptional circumstances and with prior approval from Artiste Online, no later than 5 working days prior to the exhibition.
Artists should notify Artiste Online as soon as possible if they need to withdraw their artworks.
Dispute Resolution
In the event of any dispute or disagreement arising both parties agree that arbitration shall be the mode of resolution. The arbitrator shall be mutually selected by both Artiste Online and the artist.
The decision of the arbitrator shall be final and binding on both parties, and any resulting costs or expenses shall be shared equally, unless otherwise determined by the arbitrator.
Orphaned Artwork
The parties agree that any unsold Artwork not collected (or otherwise organised by the Artist with Artiste Online) will be placed in general storage and incur a storage fee, as set out in Artiste Online’s Uncollected Storage Policy.
If unsold Artwork remains uncollected in general storage and the storage fee is greater than the price of the Artwork, Artiste Online may at its sole discretion, claim the unsold Artwork in lieu of payment of the storage fee.
